Property managers, facilities management consultants, and building-services advisors face E&O claims from both sides of every building: owners alleging mismanagement (vacancies blamed on marketing failures, deferred maintenance that became capital damage, security-deposit and trust-account mishandling, lease administration errors) and tenants alleging harm from management decisions (habitability, discrimination in applications, wrongful eviction process). Fair-housing allegations are the fastest-growing claim source for residential managers — testers file complaints professionally, and defense is required whether or not the allegation holds.
Property-management E&O covers negligence in management services and, in good forms, includes tenant-discrimination defense coverage — verify this expressly, as some forms exclude it. Managers holding rents and deposits should add crime/fidelity coverage; those directing vendors on-site need general liability coordination with owners’ policies; offices with staff need workers comp. Owners’ management agreements increasingly specify E&O limits and additional-insured wording — the contract and the policy need to be read together.

Does property manager E&O cover fair-housing complaints?
Good property-management forms include tenant-discrimination defense — but it’s a term to verify, not assume, because generic E&O forms often exclude discrimination entirely. Given HUD and tester activity, residential managers should treat this coverage as non-negotiable.
We hold security deposits and rents. What does that require?
Trust-account handling creates fiduciary and crime exposure beyond E&O: employee theft and funds-transfer fraud belong to a crime/fidelity policy, and several states require managers to account for funds under specific rules. The E&O covers management errors around the funds; crime coverage handles theft of them.
An owner says our deferred-maintenance call cost them a roof. Covered?
Claims that management judgment (repair timing, vendor selection, budget recommendations) caused property damage or lost value are core management E&O. Documentation of owner approvals is the recurring defense — managers who record owner sign-offs on maintenance decisions settle these rarely.
Do we need our own GL if every property has its own policy?
Yes — the properties’ policies protect the owners and name you as additional insured at best. Your firm needs its own GL for your operations and premises, plus E&O for management decisions. When an incident happens, all three programs get letters; you want two of them defending you.
