Real estate E&O protects agents and brokers when a buyer or seller claims your professional error cost them money — failure to disclose a property defect, a mistake in listing details or square footage, missed contract deadlines that killed a deal, or steering allegations. Deals are large, emotions run high, and even a routine transaction gone sideways can generate a demand letter; the policy’s defense-cost coverage is what keeps a dispute from consuming a season’s commissions.

Which states require E&O insurance for real estate licensees?

A number of states tie E&O to licensure or license renewal — the list changes, so check your state real estate commission’s current rule. Even where it isn’t mandated, most brokerages require agents to carry coverage or participate in the firm’s group program.

Doesn’t my brokerage’s policy already cover me?

Often partially. Group brokerage policies commonly carry higher deductibles, exclude transactions where you’re the buyer or seller, and end when you leave the brokerage. Reading the group certificate — then filling the gaps with an individual policy — is the standard approach.

Does E&O cover failure-to-disclose claims?

Failure to disclose is among the most common real estate claims, and defense of those allegations is a core function of the policy. Intentional concealment is excluded — coverage responds to alleged professional negligence, not deliberate wrongdoing.

Am I covered for property management work?
