A product I designed caused an injury. Is that my client’s problem or mine?

Both, in litigation practice — plaintiffs name everyone in the chain, and the manufacturer’s indemnity claims flow back along the contracts. Your E&O defends the professional-negligence theory against you; who ultimately pays depends on the contracts and facts. Design consultants should never sign OEM indemnities without insurance review.

Does E&O cover a scrapped production run from my design error?

A client’s financial loss from implementing your negligent design — scrapped runs, retooling, delay damages — is core design E&O territory. These claims are well-documented (POs, scrap reports) and tend to resolve on the numbers; coverage funds the defense and settlement.

What about recall costs?

Recall expense is its own insurance product and a heavily negotiated contract item — standard E&O and GL forms exclude or sharply limit it. If your designs go into consumer products, ask us about recall exposure explicitly rather than assuming any base policy handles it.

Your workers comp covers your employees wherever they work, and client contracts will require your comp certificate plus GL naming them. Client-site work also raises damage-to-client-property questions your GL should answer. The certificate package is standard OEM vendor onboarding.
